Information notice about the right of withdrawal

A consumer means any natural person who resides in the European Union and is acting for purposes which are outside his trade, business, craft or profession. If you are a consumer, you have the right to withdraw from a distant contract within 14 days as of its conclusion. This right is not available to businesses or consumers engaging in business activities (e.g. individuals engaging in frequent NFT trades). Below you are advised of your right of withdrawal with respect to the launchpad platform service (also known as the HeadStarter app) and any tokens offered through the platform.

Right of withdrawal

You have the right to withdraw within 14 days without giving any reason. The withdrawal period will expire after 14 days from the date of placing the respective token exchange order. To exercise the right of withdrawal, you must inform us of your decision to withdraw by an unequivocal statement (e.g. an e-mail). You may use the below model withdrawal form, but it is not mandatory. To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from a contract concluded with us, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. If you requested to begin the performance of services during the withdrawal period, you shall pay us an amount which is in proportion to what has been provided until you have communicated to us your withdrawal from this contract, in comparison with the full coverage of the contract.

Situations where the right of withdrawal is unavailable

In case of a service contract (e.g. the HeadStarter app services), the right of withdrawal expires once the service is provided in full (i.e. a token transaction is initiated towards the customer’s wallet address) and, if the contract places you under an obligation to pay, if the service provider has only begun to perform the service after you have given your express consent to this and at the same time confirmed your knowledge that you will lose your right of withdrawal upon full performance of the contract.

The right of withdrawal shall also expire in the case of a contract for the supply of digital content (e.g. an NFT with any associated art or in-game assets) not on a tangible medium if the supplier has commenced performance of the contract and, if the contract places you under an obligation to pay, where you have expressly consented to this commencement prior to the expiry of the withdrawal period and have confirmed your knowledge that by giving your consent you lose your right of withdrawal.
